Update on Maryland Pit Bull Case.
The Maryland Court of Appeals, the state’s highest court, issued their ruling on pit bulls and pit bull mixes back in April and still that decision is not yet law. The decision, which distinguished pit bulls or pit bull mixes from other breeds and placed greater liability on dog owners and landlords who permit tenants to have them,
quickly compelled some landlords to begin eviction proceedings against tenants with pit bulls or pit bull mixes. Prior to the Court’s decision becoming law, the Maryland Attorney General’s office filed a motion for reconsideration, which delayed the ruling becoming law.
However, without waiting for the Court of Appeals to issue a decision on the motion, the Maryland Legislature has taken up the issue. A draft bill is circulating among members which would make owners of dogs of all breeds, rather than just those of pit bulls or pit bull mixes, legally responsible for all bites. This bill also would reverse the court’s decision to extend liability to landlords, both residential and commercial.
Delegate Curt Anderson, a co-chairman of a task force that examined the ruling, stated that he believed that the bill would be introduced during the special session of the Legislature slated to take place in August of 20102.
Animal attacks are extremely traumatic for victims and their families. The damages include extensive injuries that are both physical and emotional. The decision of legislators to introduce a bill making all dog owners liable demonstrates a legitimate concern for the danger posed by dogs of all breeds.
